Terms of Service

These Terms of Service ("Terms") are a binding agreement between Quack Base Co., Ltd. ("Blebook", "we") and any business operator who signs up for and uses Blebook ("Merchant", "you"). By signing up, you confirm that you have read, understood, and agreed to all of these Terms. If you do not agree, please discontinue use.

2. Scope of Service

Blebook is a Software-as-a-Service (SaaS) platform for service businesses in Thailand. It lets Merchants:

• Create an online booking page for their shop
• Accept appointments from end customers without requiring customer signup
• Manage queues, branches, staff, and services from a Dashboard
• Use PromptPay slip verification (on supported plans) and connect Stripe Connect

3. Eligibility

• You must be at least 20 years old, or a duly registered legal entity
• You confirm your business is conducted lawfully and that you have authority to enter these Terms
• You are responsible for keeping your account credentials secure, and for all activity under your account

4. Plans and Fees

4.1 Plans

• Free — THB 0/month, forever. Up to 30 bookings/month.
• Plus — THB 290/month. Up to 1,500 bookings/month. Includes automatic slip verification (credit top-up required).
• Pro — THB 990/month. Up to 15,000 bookings/month, plus additional features.

Blebook reserves the right to change plan pricing and limits with at least 30 days' notice before any change takes effect on your account.

4.2 Payment

• Fees are billed monthly in advance
• Displayed prices are the final amount payable; Blebook is not currently VAT-registered and cannot issue tax invoices
• If payment fails, Blebook may suspend paid features and revert your account to Free

4.3 Cancellation and Refund

• You can cancel or downgrade your plan at any time from the Dashboard
• Cancellation takes effect at the end of the current billing period; Blebook does not provide pro-rated refunds
• Pre-paid slip verification credits are valid for 1 year from the date of purchase. Expired credits cannot be refunded in cash or restored.

5. Payments Between Merchant and End Customer

5.1 PromptPay

• End customers transfer funds directly to the Merchant's PromptPay account. Funds never pass through Blebook.
• Automatic slip verification relies on a third-party API and is a convenience tool only.
• Blebook does not guarantee 100% accuracy of slip verification results. Merchants are responsible for verifying actual receipt of funds in their own account.

5.2 Stripe Connect (Pro plan)

• Credit card processing through Stripe is governed by the Merchant's direct agreement with Stripe
• Payment processing fees follow Stripe's rates and are not Blebook revenue

5.3 Disputes Between Merchant and End Customer

Disputes regarding service delivery, refunds, rescheduling, cancellation, or service quality are strictly between Merchant and end customer. Blebook is not a party to and is not responsible for such disputes.

6. Merchant Data and End-Customer Data

• Merchants retain ownership of all data stored in the system ("Customer Data")
• The Merchant acts as Data Controller under Thailand's Personal Data Protection Act B.E. 2562 (PDPA) and is responsible for publishing its own privacy notice, obtaining lawful consent, and responding to data subject requests.
• Blebook acts as Data Processor and processes data only on Merchant's instructions, as further described in our Privacy Policy and PDPA Notice.

7. Acceptable Use

You may not use Blebook to:

• Operate businesses unlawful under Thai law, including illegal goods, gambling, or unlicensed lending
• Send spam, unsolicited marketing, or fraudulent content
• Collect sensitive personal data (under PDPA) without a lawful basis
• Impersonate any person, entity, or other shop without authorization
• Reverse engineer, modify, or create derivative works from the Blebook software
• Access the system using bots, scripts, or methods that abnormally load the system

Blebook reserves the right to suspend or terminate accounts that violate these Terms, without prior notice in serious or urgent cases.

8. Intellectual Property

• The Blebook software, design, trademarks, and content on blebook.com are the intellectual property of Quack Base Co., Ltd.
• Merchants receive a non-exclusive, revocable, non-transferable license to use the service for as long as the account is active and in good standing.
• Content uploaded by Merchants (logos, images, service descriptions, etc.) remains their property, but Merchant grants Blebook a license to use such content for the purposes of delivering the service to end customers, and to promote Blebook in limited contexts (e.g. case studies), with advance permission.

9. Service Availability and Changes

• Blebook strives for high availability but does not guarantee a specific uptime percentage unless agreed in a separate written agreement.
• Blebook may schedule maintenance windows for system improvements, and will give advance notice via email or Dashboard where feasible.
• Blebook may add, remove, or change features, and will give advance notice for any change with material impact.

10. Limitation of Liability

To the fullest extent permitted by law:

• Blebook provides the service "as-is" and does not warrant that the service will be error-free or uninterrupted
• Blebook is not liable for indirect, consequential, incidental damages, loss of business opportunity, loss of profit, or loss of data, regardless of cause.
• Blebook's total aggregate liability to Merchant, for all claims in any period, shall not exceed the fees paid by Merchant to Blebook in the three (3) months immediately preceding the event giving rise to liability.

The above limitations do not affect rights you have under applicable mandatory consumer protection law.

11. Indemnification

Merchant agrees to defend and indemnify Blebook against third-party claims arising from:

• Merchant's use of the service in violation of these Terms
• Infringement of intellectual property or other rights by Merchant or Merchant-uploaded content
• Merchant's non-compliance with PDPA as Data Controller

12. Termination by Blebook

Blebook may suspend or terminate a Merchant's account if:

• Merchant materially breaches these Terms
• Free-plan account is inactive for more than 12 consecutive months
• There is reasonable suspicion of fraud or serious legal risk

After termination, Blebook will retain Merchant data for up to 90 days for download, after which it will be permanently deleted, except where retention is required by law.

13. Changes to the Terms

Blebook may update these Terms from time to time. We will give at least 14 days' notice via email or Dashboard before changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

• These Terms are governed by and construed under the laws of the Kingdom of Thailand
• Any disputes shall be subject to the jurisdiction of the courts located in Bangkok, Thailand
